Terms of Service

These Terms of Service ("Terms") govern your use of dmrabbit (the "Service"), operated by Spexoid Tech Pvt. Ltd., a company registered in India ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

dmrabbit lets you automate engagement on Instagram professional accounts - for example, replying to comments and sending direct messages based on rules you define. The Service connects to Instagram through Meta's official APIs.

2. Eligibility and accounts

• You must be at least 18 years old.
• You may only connect Instagram accounts you own or are authorized to manage.
• A dmrabbit account has no password. Signing in means receiving a code or a link at your email address, so keeping that mailbox secure is what keeps your account secure. You are responsible for all activity under your account.

3. Acceptable use

You agree not to use the Service to:

• Send spam, bulk unsolicited messages, or anything deceptive or misleading.
• Harass, abuse, or harm others.
• Violate Instagram's or Meta's terms and policies, including the Meta Platform Terms and the Instagram Platform Policy.
• Break any applicable law or regulation.

You are solely responsible for the content of the automated messages and replies you configure. Misuse may result in Instagram restricting your account - which is outside our control.

4. Third-party platforms

The Service depends on Instagram and Meta APIs. We are not affiliated with, endorsed by, or sponsored by Meta or Instagram. Those platforms may change or restrict their APIs at any time, which can affect the Service. Your use of Instagram remains subject to Instagram's own terms.

5. Data protection: our agreement about your audience's data

This section is a data processing agreement between you and us. It applies whenever we handle personal information about the people who interact with your Instagram account, and it forms part of these Terms. Nothing in it changes how we handle your own account information, which is covered by our Privacy Policy.

Who decides what. The comments, direct messages and contact records that reach dmrabbit through your connected Instagram account are yours. You decide why and how they are used; you are the controller. We are your processor and act only on your instructions.

What this covers. Subject matter: providing the Service. Duration: as long as your account exists, plus the retention periods in our Privacy Policy. Nature and purpose: receiving, storing and displaying Instagram conversations, and sending the replies and messages your automations produce. Types of data: Instagram usernames and account identifiers, message and comment text and attachments, timestamps, and whether someone follows you. Categories of people: anyone who comments on or messages your connected Instagram account.

What we undertake to do.

• Process that data only on your documented instructions - which the Service itself expresses, through the automations, rules and actions you configure - including for any transfer abroad, unless a law we are subject to requires otherwise, in which case we will tell you first unless that law forbids it.
• Make sure everyone we allow to access it is bound by an obligation of confidentiality.
• Take appropriate technical and organisational security measures, including encryption in transit, access control, rate limiting, and keeping credentials out of our own data exports.
• Use sub-processors only as listed in section 6 of our Privacy Policy, under written terms no less protective than these. You give general authorisation for those listed; we will update that list before adding or replacing one, and you may object.
• Help you respond when someone exercises their rights - your dashboard already lets you read, export and delete this data yourself, and we will assist where it does not.
• Help you keep your own obligations on security, breach notification and impact assessments, and tell you without undue delay if we become aware of a breach affecting this data.
• Delete it when it expires or when you ask - disconnecting an Instagram account deletes its conversations and contacts after the period stated in our Privacy Policy, and deleting your account removes them along with everything else.
• Give you the information you reasonably need to show you comply, and cooperate with audits, on reasonable notice and no more than once a year unless a regulator requires otherwise.

What you undertake. That you have a lawful basis for the messages your automations send and for using the data you collect through dmrabbit, that your own privacy notice covers it, and that you honour requests from the people in it. We give you the tools; the relationship with your audience is yours.

6. Plans and payment

Some features may require a paid plan. Pricing and plan details are presented at sign-up or in your dashboard. Unless stated otherwise, fees are non-refundable.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that automations will always run without interruption, error, or delay, or that Instagram will deliver every message.

8. Limitation of liability

To the maximum extent permitted by law, dmrabbit is not liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of - or inability to use - the Service, including actions taken by Instagram or Meta against your account.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or misuse the Service.

10. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, notify you through the Service. Continued use after changes means you accept them.
